Welcome to Wild and Beautiful Things Photography. By accessing this website, viewing a gallery, downloading images, purchasing prints or digital files, or otherwise using our services, you agree to the following Terms of Service.

Please read these terms carefully before using our website, galleries, downloads, or store.

1. About Wild and Beautiful Things Photography

Wild and Beautiful Things Photography provides fine art photography, nature and wildlife photography, event photography, portrait photography, digital galleries, print products, and related photography services.

These Terms apply to all visitors, clients, gallery viewers, purchasers, and users of this website or any Wild and Beautiful Things Photography gallery, including galleries hosted through Pixieset.

2. Use of Website and Galleries

You agree to use this website and any client gallery for lawful, personal, and appropriate purposes only.

You may not:

  • Attempt to access private galleries without permission

  • Share private gallery links, passwords, download PINs, or access codes without permission

  • Copy, screenshot, download, alter, reproduce, sell, or distribute images except as specifically allowed

  • Use images for commercial, editorial, promotional, advertising, fundraising, or public purposes without written permission

  • Remove watermarks, crop out branding, alter copyright notices, or misrepresent ownership of any image

  • Use any image in a harmful, defamatory, misleading, obscene, unlawful, or exploitative manner

Wild and Beautiful Things Photography reserves the right to restrict or remove gallery access at any time.

3. Copyright and Image Ownership

All photographs, images, digital files, artwork, galleries, website content, text, graphics, and other creative materials are the intellectual property of Wild and Beautiful Things Photography unless otherwise stated.

Purchasing a print, product, or digital download does not transfer copyright ownership.

Wild and Beautiful Things Photography retains full copyright and ownership of all images, including the right to display, reproduce, edit, publish, license, sell, archive, and use the images as allowed by law and by these Terms.

4. Personal Use License for Digital Images

When you purchase or receive digital images, you are granted a limited, non-exclusive, non-transferable license for personal use only, unless a separate written agreement states otherwise.

Personal use may include:

  • Downloading images for personal enjoyment

  • Printing images for yourself, family, or personal display

  • Sharing images on personal social media pages

  • Using images for personal announcements, cards, gifts, or keepsakes

When sharing images online, credit to Wild and Beautiful Things Photography is appreciated and encouraged.

Digital images may not be:

  • Sold or resold

  • Entered into contests without permission

  • Used for business branding, advertising, marketing, fundraising, merchandise, logos, publications, or commercial purposes

  • Edited with filters, heavy alterations, AI manipulation, or other changes that misrepresent the original work

  • Submitted to stock image sites, AI training platforms, or third-party licensing platforms

  • Claimed as your own work

Commercial, editorial, nonprofit, publication, or business use requires written permission and may require an additional license fee.

5. Print and Product Orders

Prints, wall art, albums, cards, gifts, and other products may be fulfilled through Pixieset, professional print labs, or other third-party vendors.

Please review your order carefully before completing purchase. You are responsible for selecting the correct images, sizes, crops, finishes, quantities, shipping address, and product options.

Because photography products are custom-made, all sales are generally final unless an item arrives damaged, defective, or there is an error with the order.

6. Digital Downloads

Digital downloads are delivered electronically through the gallery or store platform.

Due to the nature of digital products, digital image purchases are final and non-refundable once delivered, downloaded, or made available, unless required by law or unless there was a technical issue caused by Wild and Beautiful Things Photography or the gallery/store platform.

You are responsible for safely downloading and backing up your digital files.

7. Color, Cropping, and Print Quality

Images may appear differently on different screens due to monitor settings, brightness, color calibration, and device differences.

Prints may also vary slightly based on paper type, product type, crop ratio, finish, lab production, and display environment.

Wild and Beautiful Things Photography is not responsible for quality issues that result from printing images through consumer labs, drugstores, discount printers, screenshots, compressed social media downloads, or unauthorized third-party vendors.

For best quality, order prints and products directly through the gallery or from a professional print lab.

8. Gallery Availability

Client galleries may be available for a limited time. Gallery expiration dates, download deadlines, or access limits may vary by session, event, collection, or product.

Wild and Beautiful Things Photography may archive, remove, disable, or delete galleries at its discretion.

Clients are responsible for downloading and backing up purchased or delivered digital images before a gallery expires.

Gallery reactivation, re-uploading, or file retrieval may not always be available and may be subject to an additional fee.

9. Model Release and Image Usage

Unless otherwise agreed in writing, Wild and Beautiful Things Photography may use images created during sessions, events, galleries, or photography services for portfolio, website, blog, social media, advertising, promotional, educational, competition, publication, display, sample product, and marketing purposes.

This may include use on:

  • Wild and Beautiful Things Photography’s website

  • Pixieset galleries or portfolio pages

  • Social media platforms

  • Print or digital marketing materials

  • Portfolio displays

  • Blog posts or educational content

  • Photography competitions, publications, or promotional features

  • Sample albums, wall art, cards, or other products

Wild and Beautiful Things Photography will make reasonable efforts to use images respectfully and tastefully.

If you have specific privacy concerns, sensitive circumstances, minors involved, foster or rescue animals, private property concerns, or do not want certain images used publicly, please communicate this in writing before or at the time of the session or event.

Wild and Beautiful Things Photography will honor written image-use restrictions when agreed to in writing.

10. Minors

Wild and Beautiful Things Photography may photograph events, horse shows, animal-related activities, family moments, candid interactions, and other settings where minors may be present.

Parents and legal guardians are responsible for notifying Wild and Beautiful Things Photography in writing if they do not want their child included in a gallery, displayed publicly, or used for portfolio, website, social media, marketing, or promotional purposes.

If a parent or legal guardian contacts Wild and Beautiful Things Photography with a privacy concern regarding a minor, we will make reasonable efforts to remove, restrict, or avoid public use of the image when appropriate.

For private portrait sessions or commissioned sessions involving minors, a parent or legal guardian must authorize the session and any specific image-use restrictions should be communicated in writing before or at the time of the session.

11. Animals, Wildlife, and Event Photography

Wild and Beautiful Things Photography may photograph animals, wildlife, horse shows, rescue animals, pets, public events, private events, or candid moments.

For animal-related sessions or events, owners and handlers are responsible for the safety, behavior, control, and handling of their animals.

Wild and Beautiful Things Photography is not responsible for injury, damage, escape, behavior, or incidents involving animals, handlers, owners, riders, spectators, property, or third parties.

At public or semi-public events, images may be captured candidly. If you have concerns about an image of yourself, your child, your animal, or your property appearing in a gallery or promotional use, please contact Wild and Beautiful Things Photography.

12. Client Responsibilities

Clients and gallery users are responsible for:

  • Providing accurate contact, billing, and shipping information

  • Reviewing gallery and order details before purchase

  • Downloading and backing up files before gallery expiration

  • Keeping private gallery links, passwords, and PINs secure

  • Communicating special privacy concerns in writing

  • Obtaining permission before sharing images of other people, children, private property, or animals they do not own

13. Refunds, Replacements, and Order Issues

Because prints, products, and digital files are custom photography items, refunds are limited.

If your print or product arrives damaged, defective, or incorrect, please contact Wild and Beautiful Things Photography within 7 days of delivery with your order details and photos of the issue.

Depending on the situation, a replacement, correction, store credit, or refund may be offered at the discretion of Wild and Beautiful Things Photography and/or the fulfillment provider.

Refunds are not typically provided for:

  • Change of mind

  • Incorrect image selection by the purchaser

  • Incorrect size, crop, finish, or quantity selected by the purchaser

  • Incorrect shipping information provided by the purchaser

  • Color differences caused by screen settings

  • Print quality issues from unauthorized third-party printing

  • Downloaded or delivered digital files

14. Editing and Retouching

All final images are edited according to the artistic style and professional judgment of Wild and Beautiful Things Photography.

Clients may not alter, heavily filter, re-edit, or apply AI modifications to images in a way that changes the integrity of the work or misrepresents the photographer’s style.

Additional retouching, edits, object removal, background changes, or special requests may be available for an additional fee and are not guaranteed unless agreed in writing.

15. Limitation of Liability

Wild and Beautiful Things Photography makes reasonable efforts to provide quality photography services, secure galleries, professional products, and a positive client experience.

However, to the fullest extent permitted by law, Wild and Beautiful Things Photography is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, lost image files, missed opportunities, emotional distress, platform outages, third-party service issues, or circumstances beyond our control.

Our total liability for any claim related to a purchase or service will not exceed the amount paid for that specific purchase or service.

16. Third-Party Platforms and Services

Wild and Beautiful Things Photography may use third-party services such as Pixieset, payment processors, print labs, shipping providers, email services, website platforms, analytics tools, and other business service providers.

Your use of those third-party services may also be subject to their own terms, privacy policies, cookie policies, shipping policies, and payment policies.

Wild and Beautiful Things Photography is not responsible for third-party platform outages, delays, data handling practices, fulfillment delays, payment processing issues, or service interruptions beyond our control.

17. Changes to These Terms

Wild and Beautiful Things Photography may update these Terms of Service from time to time. Any updates will be posted with a revised “Last updated” date.

Your continued use of this website, galleries, downloads, store, or services after changes are posted means you accept the updated Terms.
